NOTICE IS HEREBY GIVEN OF A FRIENDSWOOD CITY COUNCIL REGULAR MEETING TO BE HELD AT 6:00 PM ON MONDAY, MAY 02, 2016, AT FRIENDSWOOD CITY HALL, COUNCIL CHAMBERS, 910 S. FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS, REGARDING THE ITEMS OF BUSINESS ACCORDING TO THE AGENDA LISTED BELOW:

Council may convene into Executive Session in accordance with the Texas Government Code, pursuant to Section 551.071 – Consultation with Attorney regarding pending claims against Olson & Olson, LLP arising from settlement of legal action and Section 551.071 – Consultation with Attorney regarding contemplated litigation associated with Tax Exemption application for Whitcomb property and Section 551.072 – Deliberation regarding real property (Parkland development; legal advice only regarding potential development of real property located within the City of Friendswood) and Section 551.074 – Personnel Matters; to discuss City Attorney work schedule for month of June, 2016 and Section 551.087 – Deliberation regarding economic development negotiations; to deliberate the offer of a financial or other incentive to a business prospect.

18. Resolutions

Consideration and possible action regarding the following:

     A. Resolution R2016-04: A resolution of the City of Friendswood, Texas, Galveston/Harris counties, endorsing the reappointment of four (4) members and appointment of one (1) new member to the Galveston County United Board of Health.

     B. Resolution R2016-05: A resolution of the City Council of the City of Friendswood, Texas, designating the Mayor as the City’s representative in seeking eligible grant funds under the Justice Assistance (JAG) Grant Program for 2016-2017; and authorizing the submission of such grant application to the Criminal Justice Division of the Office of the Governor.

     C. Resolution R2016-06: A resolution of the City of Friendswood, Texas, opposing Central Region Alternative #2 (CR #2) of the Gulf Coast Community Protection and Recovery District (GCCPRD) Storm Suppression Study, and supporting Central Region Alternative #1 (CR #1); providing for the delivery of such resolution to the GCCPRD, as well as Regional Economic Development agencies and State Legislators that represent Harris County and other gulf coast communities.

     D. Resolution R2016-07: A resolution of the City of Friendswood, Texas, finding that CenterPoint Energy Houston Electric, LLC’s, application for approval to amend its Distribution Cost Recovery Factor pursuant to 16 Tex. Admin. Code § 25.243 and to reconcile Docket No. 44572 revenues to increase distribution rates within the City should be denied; finding that the City’s reasonable rate case expenses shall be reimbursed by the company; finding that the meeting at which this resolution is passed is open to the public as required by law; requiring notice of this resolution to the company and legal counsel.

     E. Resolution R2016-08: A resolution of the City Council of the City of Friendswood, Texas, suspending the May 30, 2016, effective date of the proposal by CenterPoint Gas Texas Coast Division to implement interim grip rate adjustments for gas utility investment in Texas and requiring delivery of this resolution to the company and legal counsel.

19. Ordinances

Consideration and possible action regarding the following:

     A. Ordinance No. T2016-17: (Title: Second and Final reading of an ordinance approving a vacation of a portion of a public right-of-way) An ordinance approving a vacation of a portion of a public right-of-way situated on property located at 906 Murphy Lane, Friendswood, Texas; authorizing the Mayor to execute and the City Secretary to attest a quitclaim deed by and between the City and Christi Saban.

     B. Ordinance No. T2016-21: (Title: Second and Final reading of an ordinance adopting the 2012 International Code Council versions of the International Building Code, International Plumbing Code, International Mechanical Code, International Fuel Gas Code, International Energy Conservation Code and International Residential Code for One-and Two-Family Dwellings; adopting the 2011 version of the National Electrical Code; and adopting local amendments) An ordinance amending the Code of Ordinances of the City of Friendswood, Texas, Chapter 14 "Buildings and Building Regulations" by adopting the 2012 International Building Code, 2012 International Plumbing Code, 2012 International Mechanical Code, 2012 International Fuel Gas Code, 2012 International Energy Conservation Code and International Residential Code for one- and two-family dwellings; adopting the 2011 National Electrical Code; adopting local amendments thereto; providing other matters relating to the subject; providing for a penalty of an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability.

     C. Ordinance No. T2016-22: (Title: Second and Final reading of an ordinance adopting the 2012 International Fire Code and 2012 Life Safety Code, with local amendments) An ordinance amending the Code of Ordinances of the City of Friendswood, Texas, Chapter 30 "Fire Protection and Prevention", Article III. "Fire Codes" by adopting the 2012 International Fire Code and the 2012 Life Safety Code; adopting local amendments thereto; providing other matters relating to the subject; providing a penalty of an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability.

     D. Ordinance No. T2016-23: (Title: Second and Final reading of an ordinance rezoning a 1.5189 acre tract of land located at 311 S. Friendswood Dr., Friendswood, Texas, (as more fully described herein), from Light Industrial (LI) to Downtown District (DD)) An ordinance amending Appendix "C" "Zoning", of the Code of Ordinances of the City of Friendswood, Texas, by amending the zoning classification for a 1.5189 acre tract of land located at 311 S. Friendswood Dr., Friendswood, Texas, being out of a called 1.586 acre tract conveyed from J.R. May and wife, Louise May, to Charles C. Lary, III, and recorded under Galveston County Clerk’s file number 8549620, being part of Lot 9, Block 2, of Friendswood Subdivision, as recorded in Volume 238, Page 14, in the office of the County Clerk of Galveston County, Texas, located in the Sarah McKissick or J.R. Williams League, Galveston County, Texas; amending the zone classification from Light Industrial (LI) to Downtown District (DD), all as more specifically provided herein; providing for the amendment of the Official Zoning Map; providing a penalty in an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability.

     E. Ordinance No. T2016-24: (Title: Second and Final reading of an ordinance approving an amendment to Ordinance No. 2012-04 approving an annual rate adjustment for solid waste collection and disposal) An ordinance amending Ordinance No. 2012-04 in order to approve an annual rate adjustment as provided for in the City of Friendswood – IESI Solid Waste franchise. (Now known as Progressive Waste Solutions)

     F. Ordinance No. T2016-26: (Title: First and Final reading of an ordinance adopting Budget Amendment VII to the Original General Budget of the City for Fiscal Year 2015-2016 to provide for supplemental appropriation and/or transfer of certain funds) An ordinance amending City of Friendswood, Texas, Ordinance No. 2015-27, passed and approved October 5, 2015, same being an ordinance approving and adopting the City’s General Budget for Fiscal Year 2015-2016 by approving "Budget Amendment VII" to the "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2015-2016"; providing for supplemental appropriation and/or transfer of certain funds; providing for severability; and providing other matters related to the subject.

Consideration and possible action regarding the following:

     A. Approving a Memorandum of Understanding (MOU) with Friendswood Independent School District (FISD) for use of their facilities for an ongoing City program

     B. Approving an agreement with YMCA for the use of the Sesquicentennial Swimming Pool

     C. Approving an Encroachment agreement with Chevron Phillips Chemical Company, LP, for improvements at Renwick Park

     D. Accepting the March 2016 Property Tax Report
